1. 接受條款

使用 XK+ COMPASS（「本服務」）即表示你同意本使用條款及隱私政策。如不同意，請停止使用。本服務由 WEBCA Lab（「我們」）提供。

2. 學習用途、非商業授權與重要限制

本服務及其內容只授權作個人學習、研究及非商業用途。未經 WEBCA Lab 事先書面許可，不得出售、轉售、出租、代表客戶提供收費服務、納入商業產品，或以其他方式作商業利用。本服務提供羅盤感測、坐向讀數、排盤、Snapshot、列印及會員紀錄工具，僅供一般資訊與記錄用途，不構成風水、建築、工程、測量、安全、法律或其他專業意見。

裝置感測器會受磁場、校準、保護殼、環境及硬件差異影響。你有責任在每次使用前校準裝置、以其他可靠方法交叉核實數據，並自行判斷讀數是否準確及符合你的特定用途。不得僅依賴本服務作出財務、建築、安全或其他重要決定；需要時請諮詢合資格專業人士。

3. 訪客與會員功能

訪客可使用 Snapshot 及列印。會員功能採邀請制，可包括量測同步、查看、重新下載、改名、刪除、留言支援及優先測試。你須提供準確資料、保護登入憑證，並對帳戶下的活動負責。不得分享邀請、冒用他人身分或未經授權存取其他帳戶。

4. Founding VIP

首 24 位完成帳戶啟用的會員可獲不可轉讓的 Founding VIP 身分。VIP 可優先參與新版本測試；日後的付費功能將按該功能推出時公布的安排，提供免費使用或優惠折扣。權益沒有現金價值，並須視功能供應、技術可行性與資格要求而定。我們不會追溯取消已正當授予的 VIP 身分，但可因欺詐、濫用或嚴重違反本條款而暫停相關帳戶。

5. 可接受使用

你不得干擾服務、規避保安措施、上載惡意內容、侵犯他人權利、違法使用服務，或以自動化方式造成不合理負荷。支援留言不得包含違法、威脅、騷擾或侵權內容。

6. 內容與知識產權

本服務的品牌、介面、程式、圖像及內容由我們或授權方擁有。你保留自己提交的標題、留言與量測資料之權利，並授予我們僅為營運、保存、支援及改善服務所需的有限許可。你可按隱私政策要求刪除個人資料。

7. 第三方服務

登入、託管、儲存或其他功能可能使用 Google、Netlify 等第三方服務；其服務亦受其各自條款與政策約束。我們不控制第三方服務的持續可用性。

8. 變更、暫停與終止

Alpha 版本仍在開發中，功能、版面或資料格式可能改變。我們可為維護、保安、法律要求或停止營運而修改或暫停服務。你可停止使用服務，並可透過會員支援要求刪除帳戶。

9. 免責與責任限制

在法律允許的最大範圍內，本服務按「現狀」及「可用」基礎提供，不保證任何讀數或排盤準確、完整、適合特定用途，亦不保證資料保存或服務不中斷。因讀數錯誤、不準確、不完整、不適用，或使用者未有校準、核實或判斷數據是否符合用途而導致的損失，我們不承擔責任。對因使用或無法使用本服務而產生的間接、附帶、特殊或後果性損失，我們亦不承擔責任。本條款不排除加拿大或卑詩省法律不得排除或限制的保證、權利或責任，包括適用的消費者權利。

10. 管轄法律

本條款受加拿大卑詩省法律及適用的加拿大聯邦法律管轄。任何爭議由卑詩省具管轄權的法院處理，但適用法律賦予消費者的其他法定申索地或權利不受影響。

11. 變更與聯絡

我們可更新條款並在本頁標示新生效日期。重大變更會在合理可行情況下通知會員。問題可透過會員中心留言，或前往 www.webca.com 聯絡我們。

English Version

1. Acceptance

By using XK+ COMPASS (the “Service”), you agree to these Terms and the Privacy Policy. If you do not agree, stop using the Service. The Service is provided by WEBCA Lab (“we,” “us,” or “our”).

2. Educational use, non-commercial licence, and important limitations

The Service and its content are licensed only for personal learning, study, and non-commercial use. Without WEBCA Lab’s prior written permission, you may not sell, resell, rent, use the Service to provide paid client services, incorporate it into a commercial product, or otherwise exploit it commercially. The Service provides compass sensing, direction readings, charting, Snapshot, printing, and member record tools for general information and record-keeping only. It is not feng shui, architectural, engineering, surveying, safety, legal, or other professional advice.

Device readings may be affected by magnetic fields, calibration, cases, surroundings, and hardware. Before every use, you are responsible for calibrating the device, cross-checking data by another reliable method, and determining whether readings are accurate and suitable for your particular purpose. Do not rely solely on the Service for financial, construction, safety, or other important decisions; consult a qualified professional where appropriate.

3. Guest and member features

Guests may use Snapshot and printing. Invitation-only member features may include measurement syncing, viewing, re-downloading, renaming, deletion, support messages, and early testing. You must provide accurate information, protect your credentials, and are responsible for account activity. You may not share invitations, impersonate others, or access another account without authorization.

4. Founding VIP

The first 24 members to activate their accounts receive non-transferable Founding VIP status. VIPs receive priority opportunities to test new releases. Future paid features will be offered free or at a preferential discount according to the terms announced when each feature launches. Benefits have no cash value and depend on feature availability, technical feasibility, and eligibility. We will not retroactively revoke properly granted VIP status, but may suspend an account for fraud, abuse, or a serious breach of these Terms.

5. Acceptable use

You may not interfere with the Service, bypass security, upload malicious material, infringe rights, use the Service unlawfully, or impose unreasonable automated load. Support messages must not contain unlawful, threatening, harassing, or infringing content.

6. Content and intellectual property

Our brand, interface, software, graphics, and content are owned by us or our licensors. You retain rights in titles, messages, and measurement data you submit and grant us a limited licence only as needed to operate, store, support, and improve the Service. You may request deletion as described in the Privacy Policy.

7. Third-party services

Authentication, hosting, storage, or other functions may use third parties such as Google and Netlify and are also subject to their terms and policies. We do not control the continued availability of third-party services.

8. Changes, suspension, and termination

This Alpha Service is under development, and features, layout, or data formats may change. We may modify or suspend the Service for maintenance, security, legal requirements, or discontinuation. You may stop using it and request account deletion through member support.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without any guarantee that readings or charts are accurate, complete, or fit for a particular purpose, or that data will be preserved or the Service will remain uninterrupted. We are not liable for loss caused by an incorrect, inaccurate, incomplete, or unsuitable reading, or by a user’s failure to calibrate, verify, or determine whether data is suitable for the intended use. We are also not liable for indirect, incidental, special, or consequential loss arising from use or inability to use the Service. Nothing in these Terms excludes warranties, rights, or liabilities that cannot lawfully be excluded or limited under Canadian or British Columbia law, including applicable consumer rights.

10. Governing law

These Terms are governed by the laws of British Columbia and applicable federal laws of Canada. Disputes are subject to courts of competent jurisdiction in British Columbia, without limiting any other venue or right available to consumers under applicable law.

11. Updates and contact

We may update these Terms and post a new effective date. We will provide reasonable notice of material changes where practicable. Contact us through member support or at www.webca.com.

Language: The Chinese version is provided for convenience. If the two versions differ, the English version governs to the extent permitted by law.
